Terms and Conditions

The www.oharadesigns.com Web Site (herein referred to as the "website" or (oharadesigns.com") is an online fashion retailer, owned and operated by O’Hara Designs Pty Ltd (ABN 71 127 818 964). Use of this website indicates you have read, understand and accept the following terms and conditions. Furthermore, all purchases completed through the website are bound by these terms and conditions. 

 
ELIGIBILITY AND PURCHASE
In order to make purchases through the site, you will be requested to register and provide your personal details. In particular, customers must provide their real name, phone number, e-mail address and other requested information as indicated. Furthermore, when ordering items, you will be required to provide payment details through Paypal and you represent and warrant that the payment details you provide on ordering are both valid and correct and you confirm that you are the person referred to in the Billing information provided. 
 
PRICES AND ORDERS 
All orders are subject to acceptance and availability. 
 
Prices are listed in Australian dollars and include GST (Australian Goods and Services Tax) where applicable. All information contained on the website is believed to be accurate and reliable at the time of publishing. Errors and/or omissions may occur. Oharadesigns.com reserves the right to modify any information (including product descriptions and pricing) without notice. 
 
All orders should be considered to be an offer by the customer to purchase at the listed price (plus delivery charges where applicable). Oharadesigns.com reserves the right to refuse any order, in such a case the customer will be notified and the situation explained. 
All prices are GST inclusive. 
Postage and handling is FREE for Australian orders.
Postage and handling is an additional cost for International Orders.
Payment is made through Paypal by a Paypal account or as a guest to Paypal by entering in your credit card details.
 
DELIVERY TIME
Australian Domestic shipping:
All orders will be dispatched once the payment has cleared.
Our chosen courier company is Australia Post or Fastway couriers.
The parcel can take 2-5 working days to arrive depending on where you live.
If you choose Express Post, you will need to pay for express postage.  Your express post order will be delivered the next working day for all orders placed before 11:00am AEST.
You must provide a physical address for delivery i.e. no PO Box’s are accepted.  If you are not going to be home then it’s advised that you give a work address so that someone will be there to receive the parcel.
Once the parcel has been delivered, we are not responsible for theft or damage to the goods. 
 
Shipping to International Destinations (outside of Australia):
Generally, shipments are delivered to most countries within 14 working days, however, due to various countries Customs Procedures, we cannot assume responsibility for delays.
We ship via Air mail or Sea Mail.  Please choose your preference at the online checkout.

For us to process your international order, you must read and accept the following agreement:
You are responsible for any duties, tariffs, customs charges or additional charges levied by your country of entry. Furthermore, Oharadesigns.com is not responsible for any additional charges once the items you have ordered have left Australia. 
If you have questions regarding customs or duties charges and procedures in your country, it is your responsibility, not ours, to research this information PRIOR to placing your order.
Please note delivery times are an estimate only and cannot be guaranteed in every case.
 
PURCHASE POLICY
 
Refunds
- Sorry, OHARA do not offer refunds on any of our products so please choose your product carefully.  If you change your mind, we do offer exchanges or credit note but we will not refund your money.  If you would like to exchange your product, please notify OHARA within 5 working days from the date the product was delivered.  You can then arrange to send the product back to OHARA.  OHARA will only accept products back that are in all their original packaging with all the correct tags on.  Once OHARA has received and reviewed the return they can send out your new desired product or they can offer a credit note.  All credit notes are valid for 6 months.
 
- When you have received your order, please check the product thoroughly.  If the product has been damaged in any way you must notify OHARA within 5 working days.  Failure to notify OHARA within this time frame means that any damage to the product must have occurred and will be deemed to have occurred after the product was delivered and it will therefore not be the responsibility of OHARA.
 
- If your product has been damaged and you have notified OHARA within 5 working days, you can then arrange to send the product back to OHARA.  Once OHARA has received and reviewed the returned product, they will work with you on the next available options.
 
- OHARA will aim to deliver exactly what was ordered but human error may happen from time to time.  Please check that what you ordered was what was delivered.  If by any chance you were given a different colour or size to what was ordered, you must notify OHARA within 5 working days from the date the product was delivered.   Once OHARA has received and reviewed the returned product, they will send out a new product in the correct size and colour.  
 
Clothes
- Please treat your OHARA garment with care.  We use a lot of delicate fabrics in our clothing collection so please follow the care instructions provided with the garment.  OHARA will not be held responsible for misuse or for the wear of a garment.  
 
Leather Accessories
- Please treat your OHARA accessory with care.  OHARA use genuine leathers in our accessory range.  Leather is a natural product therefore natural markings are unique characteristics of your product. Leather products are designed to age with wear and will soften with use.  OHARA will not be held responsible for the wear of your leather product.  If however there is a manufacturing fault that occurs within 3 months of the date you purchased the product, OHARA will repair the product at no cost to you.  If a manufacturing fault occurs, please notify OHARA and send the item back to OHARA to be reviewed.  Manufacturing faults include broken clasps, broken plates, broken zips, broken studs that have occurred on their own (not from wear and tear). OHARA will review the product to ensure that it was in fact a manufacturing fault and not wear and tear of the product and if it is proven to be a manufacturing fault OHARA will repair the product and send it back to you within 6 weeks.  OHARA is not responsible for any repairs after 3 months from the date of purchase.
 
Exchanges
Once you receive your order, if the size or colour is not quite right for you then we will gladly exchange the product for a smaller or larger size, or for a different colour (subject to availability).  
Please notify us on 1300 870 830 or info@oharadesigns.com as soon as you intend to exchange the product.  This must be done within 5 days of the delivery date.  We will promptly reply to your email and advise of the delivery address (or give you the address over the phone if you choose to call 1300 870 830 within Australia).
Please inform us of what OHARA item available online at Oharadesigns.com that you would like to exchange the product for (subject to availability).    
If you choose a product of a lesser value then a credit note can be given to make up the difference.  All credit notes are valid for 6 months.
Then send back the product and ensure the item is in brand new as it was purchased.  Please ensure that it’s in perfect condition, has all tags attached, and with the invoice of purchase.
We reserve the right to refuse an exchange if we believe the product has been worn, or if the product is damaged in anyway.  When trying on shoes, please ensure you try them on a carpeted surface to avoid any damage.
If the product is in its original condition, we will exchange the product or issue you with a credit note. 
Sorry, we do not offer refunds - so please be careful when purchasing your O’Hara Designs product. 
 
FAULTY GOODS
Goods are faulty if they are received damaged or where a manufacturing fault occurs within three months of purchase. Please note that items that are damaged as a result of normal wear and tear are not considered to be faulty. 
Where possible, we will offer to repair faulty items or offer you the most cost effective and convenient option for you. 
 
PRODUCT DISPLAY
Oharadesigns.com attempts to display as accurately as possible the colors of the products shown on the site. However because the colors you see will depend on many factors, including your screen monitor or printer, Oharadesigns.com cannot guarantee that the color you see matches the product color. Oharadesigns.com provides a detailed image, description and size of each product, ensuring you are provided with accurate information.
 
COPYRIGHT
You must comply with all proprietary and copyright notices on this site. This Website is owned by O’Hara Designs Pty Ltd and is subject to copyright. The information on this Site is protected under Australian copyright laws. Subject to provisions of the Copyright Act 1968 (Australia), you must not in any form or by any means:
a) copy, adapt, reproduce, broadcast, store, transmit, distribute, print, publish or create derivative works from any information or material on this Site;
b) alter, decompile, disassemble, reverse engineer or modify any material or information that you receive from this Site which can be accessed through this Site;
c) use or apply, for commercial purposes any material or information on this Site, without the prior written consent of O’Hara Designs Pty Ltd.
 
DISCLAIMER
In no event will Oharadesigns.com be liable for (I) any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of profits, business interruption or loss of anticipated savings) arising out of the use of or inability to use the website, or products purchased through this service. Or (II) any claim attributable to errors, omissions, or other inaccuracies listed on oharadesigns.com. 
 
WE RESERVE THE RIGHT:
to cancel any order, at which time, we will immediately notify this action by email or phone, using the email address or number/s provided. We will refund the monies paid using the original method received. 
that all orders are subject to availability of stock.
to take reasonable steps to verify that the order and credit details are bona fide
